Alimony refers to payments made to support a spouse before or after a separation or divorce.
Alimony is meant to help divide a separated or divorced couple’s resources and can be paid as a lump sum or in monthly installments. It could also be done by transferring property. A judge will decide whether the support payments are temporary or permanent.
Alimony is awarded to lower-earning spouses under certain circumstances, but it is not guaranteed. The decision will depend on how long you were married and other factors.
If you receive alimony payments, you must report them on your income tax return. You can deduct it from your tax return if you pay alimony or spousal support. There are different federal and state tax rules, so be sure to speak to your lawyer or accountant to be certain of your obligations.
A family court judge decides eligibility for spousal support based on the petitioner’s financial situation, employment, earning potential, and whether the custodial parent can seek employment without impacting the welfare of the child.
If financial circumstances change, such as if the supporting spouse’s income changes or the supported spouse starts working, either party can ask for the agreement to be modified.
In general, spousal support is awarded for 60-70% of the length of the marriage.
